We operate this store and website, including related information, content, features, tools, products and services (together, the "Services").

Please read these Terms carefully before using the Services or placing an order.

Nothing in these Terms affects any statutory rights that cannot lawfully be excluded or limited, including rights available to consumers under applicable consumer-protection law.

2. Eligibility and Use of the Services

You may use the Services only for lawful purposes and in accordance with these Terms.

By placing an order, you confirm that:

  • You are at least 18 years of age, or have the express consent and active supervision of a parent or legal guardian (who accepts these Terms on your behalf and accepts responsibility for your use of the Services);

  • You are legally capable of entering into a binding contract under the laws of your country of residence;

  • The information you provide is accurate, current and complete;

  • You are authorised to use the payment method submitted with your order; and

  • You will not use our products or Services for unlawful, commercial resale, fraudulent or unauthorised purposes.

Note on purchases by persons under 18: Under English law, contracts entered into by persons under 18 may be voidable. If you are under 18, you must have a parent or guardian place the order and accept these Terms on your behalf. We reserve the right to cancel and refund an order where we have reasonable grounds to believe it was placed by a person under 18 without appropriate parental consent.

If customer accounts are available, you are responsible for maintaining the confidentiality of your login details and for all activity that occurs through your account. Please tell us promptly at contact@joingxm.com if you suspect unauthorised access to your account.

3. Products and Product Information

GXM Kingdom sells physical products, including apparel and physical journals, as well as digital products, including downloadable PDF journals, trackers, guides and similar content.

We take reasonable care to ensure product descriptions, images, prices and availability information are accurate. However:

  • Colours and product appearance may vary slightly depending on your device, display settings, lighting and the manufacturing process.

  • Images are for illustration purposes where stated and may not always show every product detail.

  • Product packaging may vary from images shown.

  • We may correct genuine errors, inaccuracies or omissions relating to descriptions, prices, promotions, availability, shipping charges or delivery estimates.

We may update, modify, discontinue or limit the availability of products from time to time. This will not affect orders that we have already accepted, except where an item is unavailable or an obvious error has occurred. If this happens, we will contact you and provide an appropriate refund where payment has been taken.

Nothing in this section removes your legal rights where a product is faulty, misdescribed, not of satisfactory quality or otherwise does not comply with applicable law.

4. Digital Products - Personal-Use Licence and Technical Information

Nature of purchase: When you purchase a digital product from GXM Kingdom - such as a downloadable PDF journal, tracker or guide - you are purchasing a limited licence to use the digital content, not ownership of the intellectual-property rights in that content.

Licence grant: Subject to payment in full and compliance with these Terms, we grant you a personal, non-exclusive, non-transferable, revocable licence to download and use the digital product for your own private, non-commercial use only.

Technical information and compatibility: Our digital products are supplied as PDF files. Before purchasing, you should ensure you have:

  • A compatible device (computer, tablet, smartphone or similar);

  • Access to the internet sufficient to download the file;

  • A PDF reader or compatible application (such as Adobe Acrobat Reader, Apple Books, Google Drive, or similar); and

  • Sufficient storage space to download and save the file.

Technical protection measures: Some of our digital products may include technical protection measures such as watermarking, download limits, or access restrictions to protect our intellectual property. Details of any such measures will be stated on the relevant product page. We do not currently apply DRM (Digital Rights Management) restrictions that would prevent you from printing or viewing the file for your own personal use, unless stated otherwise on the product page.

Interoperability: Our PDF products are designed to be compatible with standard PDF readers across Windows, macOS, iOS and Android platforms. If you experience compatibility issues, please contact us at contact@joingxm.com before purchasing to confirm compatibility with your device.

Restrictions: Unless we give you prior written permission, you must not:

  • Share, distribute, sell, resell, sublicense, rent, loan or transfer a digital product to another person;

  • Upload the product to a website, cloud-storage platform, marketplace, social-media platform, file-sharing service or public or private group;

  • Reproduce, copy, modify, adapt, translate, extract, create derivative works from or commercially exploit any digital product;

  • Remove copyright, trademark, ownership or other proprietary notices;

  • Claim that the digital product or any part of it is your own work;

  • Use our digital content to create, sell or distribute competing products; or

  • Use the content for commercial, educational, organisational or client-facing purposes without our written permission.

Digital products are supplied as described on the relevant product page. Unless expressly stated otherwise, they are digital PDF downloads only and no physical item will be posted.

If you do not receive a download link, experience a genuine technical access issue, or receive a corrupted file, contact us immediately at contact@joingxm.com and we will provide a replacement link or file.

Your statutory rights relating to faulty or non-conforming digital content under the Consumer Rights Act 2015 are explained in our Returns, Refunds & Cancellations Policy and are not affected by these Terms.

5. Informational and Wellbeing Content

GXM Kingdom's journals, trackers, guides and related content may include general information, prompts, reflective exercises, productivity tools, lifestyle ideas or personal-development content.

Unless expressly stated otherwise, our content is provided for general informational, educational and personal-use purposes only. It is not medical, mental-health, psychological, therapeutic, legal, financial, tax, nutritional, fitness or other regulated professional advice.

You should not rely on our products as a substitute for advice, diagnosis or treatment from a qualified professional. Always seek advice from an appropriately qualified professional regarding your personal circumstances.

We do not guarantee any particular outcome, result, improvement, income, productivity level, health outcome, wellbeing outcome or personal result from using our products. Individual experiences and outcomes will vary.

Nothing in this section excludes or limits liability where it would be unlawful to do so.

6. Orders and Contract Formation

When you place an order, you are making an offer to purchase the selected product or products.

After you place an order, we will send an acknowledgement email confirming that we have received it. This acknowledgement does not mean that we have accepted your order.

A contract between you and us is formed when we send you an order-confirmation email confirming acceptance of the order, or when we dispatch the physical product, whichever occurs first.

For digital products supplied immediately after payment, the contract is formed when we confirm your order and make the download link available to you.

We may be unable to accept an order where, for example:

  • The product is unavailable;

  • We identify an obvious pricing, product-description or technical error;

  • Payment authorisation fails;

  • We reasonably suspect fraud, unlawful activity or unauthorised resale; or

  • Delivery cannot reasonably be arranged for your location.

If we cannot accept your order after payment has been taken, we will notify you and issue a full refund of the amount paid as soon as reasonably practicable and in any event within 14 days.

7. Prices, Payment, Taxes and Customs Charges

Prices are shown in the currency stated at checkout and are those applicable at the time you submit your order.

Unless clearly stated otherwise at checkout, product prices may not include: delivery charges; customs duties; import taxes; local sales taxes; or other destination-country charges.

Any applicable delivery charge will be clearly shown before you complete checkout.

For international orders, you are responsible for customs duties, import taxes, clearance fees and similar charges imposed by the destination country, unless we expressly state otherwise at checkout.

You must provide accurate, current and complete payment, billing and contact information. Payments are processed through the payment methods made available at checkout. We do not store full payment-card details.

8. Your Right to Cancel - 14-Day Cooling-Off Period

Physical products: In accordance with the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, if you are a consumer purchasing physical goods, you have the right to cancel your order within 14 days of receiving the goods, without giving any reason. Following cancellation, you have a further 14 days to return the goods to us.

Digital products: For digital products, you have the right to cancel within 14 days of purchase. However, if you have requested that supply of the digital product begins immediately and you have given your express consent and acknowledged that your right of cancellation will be lost once the download begins, your right to cancel is waived from the moment the download commences.

How to cancel: To exercise your right to cancel, contact us clearly in writing at contact@joingxm.com before the cancellation period expires, stating your name, order number and intention to cancel.

Refunds following cancellation: Where a valid cancellation is exercised, we will refund all payments received from you, including standard delivery charges (if any), within 14 days of receiving the returned goods or your confirmation of return, using the same payment method you used for the original purchase.

Return costs: Unless the item is faulty, damaged or misdescribed, you are responsible for the cost of returning physical goods to us following cancellation.

9. Delivery of Physical Products

Our physical-product delivery arrangements are set out in our Shipping Policy.

Any delivery dates or timeframes we provide are estimates only unless we expressly agree otherwise. Where no specific delivery date is agreed, we will deliver within 30 days of the contract being formed, in accordance with the Consumer Contracts Regulations 2013. If we fail to meet this obligation, you may have the right to treat the contract as ended and receive a full refund.

We are not responsible for delays outside our reasonable control, including delays caused by carriers, customs, severe weather, strikes, border controls or other events beyond our control. Where a significant delay occurs, we will take reasonable steps to keep you informed and help resolve the issue.

For consumer purchases, risk in physical goods passes to you when the goods are delivered to you, or to a person you have nominated to receive them. Risk does not pass merely because the goods have been handed to a delivery carrier.

You are responsible for providing a complete and accurate delivery address. If an item is returned to us due to an incorrect address, failed delivery, refusal of delivery or unpaid import charges arising from the customer's actions, we may deduct reasonable unrecoverable delivery, return or carrier costs from a refund where permitted by law.

10. Faulty, Damaged or Non-Conforming Products

Nothing in these Terms affects your statutory rights where goods or digital content are:

  • Faulty or damaged at the time of delivery;

  • Not of satisfactory quality;

  • Not fit for purpose; or

  • Not as described.

Under the Consumer Rights Act 2015, you may be entitled to a repair, replacement, price reduction or refund depending on the circumstances and timing. Your rights are set out in our Returns, Refunds & Cancellations Policy.

11. Intellectual Property

The Services and all content made available through them -  including our name, branding, logos, product designs, PDFs, text, graphics, images, videos, downloads, layouts, designs and other materials - are owned by or licensed to Thomas Michael Brian Binns, trading as GXM Kingdom, and are protected by UK and international intellectual-property laws.

Except for the limited personal-use licence expressly granted for purchased digital products, no ownership interest or intellectual-property right is transferred to you.

You must not use our name, logo, branding, trademarks or copyrighted material without our prior written consent.

12. Customer Reviews, Feedback and User Submissions

If you submit reviews, feedback, comments, suggestions, images or other content to us ("User Content"), you confirm that:

  • You own the content or have the necessary rights and permissions to submit it;

  • It is accurate and honest to the best of your knowledge;

  • It does not infringe another person's rights;

  • It is not unlawful, defamatory, abusive, threatening, misleading, obscene or offensive; and

  • It does not contain malware, harmful code or unsolicited advertising.

You grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce, display, publish and distribute your User Content for the purposes of operating, promoting and improving GXM Kingdom and the Services, provided that we will not use your User Content in a way that misrepresents your views or distorts the meaning of what you submitted.

We may remove User Content where we reasonably believe it breaches these Terms, infringes rights, is unlawful or is misleading.

Nothing in this section affects any rights you may have under applicable data-protection law.

The Services may contain links to, integrations with or tools supplied by third parties, such as Shopify, payment providers, delivery providers, social-media platforms, advertising platforms, analytics providers and other service providers.

Third-party services are governed by their own terms and privacy policies. We are not responsible for the content, availability, security or privacy practices of external websites or services that we do not control.

We may provide access to third-party tools without controlling or monitoring those tools. This does not limit any rights or remedies you may have against us that cannot lawfully be excluded.

14. Prohibited Use

You must not use the Services:

  • For unlawful, fraudulent, harmful or malicious purposes;

  • To infringe our intellectual-property rights or the rights of another person;

  • To transmit malware, viruses or harmful code;

  • To interfere with the security, functionality or operation of the Services;

  • To obtain unauthorised access to any part of the Services;

  • To harvest, collect or misuse personal information;

  • To submit false, misleading or fraudulent information;

  • To send spam, phishing messages, chain letters or unsolicited promotional material;

  • To scrape, copy, extract, reproduce or systematically collect website content, product data or customer information without our written permission; or

  • To use bots, automated systems, AI agents or similar tools to access the Services in a way that overloads, bypasses, disrupts or circumvents our security, access controls or technical measures.

We may suspend or restrict access to the Services where reasonably necessary to protect the Services, customers, our rights, or other users, or where we reasonably believe these Terms have been breached.

15. Privacy and Data Protection

We process personal information in accordance with our Privacy & Cookie Policy, including in connection with the use of advertising pixels and tracking technologies from third-party platforms such as Meta (Facebook/Instagram), TikTok, Pinterest, Snapchat and Google.

Thomas Michael Brian Binns, trading as GXM Kingdom, is in the process of registering as a data controller with the Information Commissioner's Office (ICO). Once registration is complete, the registration number will be added to this policy.

Our store is hosted by Shopify. Shopify and other service providers may process personal information as necessary to provide the Services. For further information on Shopify's processing, see the Shopify Consumer Privacy Policy.

16. Complaints

We are committed to resolving any issues you experience with our products or Services promptly and fairly.

Step 1 - Contact us directly: If you have a complaint, please contact us first at contact@joingxm.com or in writing to 8 Lancaster Drive, Hull, East Riding of Yorkshire, HU8 0HJ, United Kingdom. We aim to acknowledge complaints within 2 business days and provide a substantive response within 14 days.

Step 2 - Alternative Dispute Resolution (ADR): We are not currently subscribed to a specific ADR scheme. However, if we are unable to resolve your complaint to your satisfaction, you may seek assistance from:

  • Citizens Advice Consumer Service: 0808 223 1133 / citizensadvice.org.uk

  • Trading Standards: Via Citizens Advice or your local council

Data protection complaints: Complaints about the handling of your personal data may be referred to the Information Commissioner's Office (ICO): ico.org.uk / 0303 123 1113.

Note: The EU Online Dispute Resolution platform does not apply to UK-based businesses following the UK's departure from the European Union.

17. Liability

We are responsible for losses you suffer as a foreseeable result of our breach of these Terms or our failure to use reasonable care and skill. Losses are foreseeable where they are an obvious consequence of our breach or where they were contemplated by both you and us when the contract was made.

Nothing in these Terms excludes or limits our liability for:

  • Death or personal injury caused by our negligence;

  • Fraud or fraudulent misrepresentation;

  • Breach of your statutory rights relating to goods, digital content or services under the Consumer Rights Act 2015;

  • Any other liability that cannot lawfully be excluded or limited.

Subject to the above, we are not responsible for losses that are not foreseeable, losses caused by events outside our reasonable control, or business losses suffered by consumers, including loss of business, loss of profits, loss of opportunity or business interruption.

We do not guarantee that the Services will always be available, uninterrupted, secure or error-free. We will use reasonable care and skill in providing the Services.

18. International Customers and Mandatory Local Rights

GXM Kingdom is based in England, United Kingdom, but we may make products available to customers in other countries.

Where you are a consumer outside the United Kingdom, you may have mandatory consumer-protection rights under the laws of your country of residence. These Terms are not intended to remove or reduce those mandatory rights. If a provision of these Terms conflicts with mandatory law that applies to you, that mandatory law will apply to the extent of the conflict.

19. Governing Law and Jurisdiction

These Terms and any dispute or claim arising from them are governed by the laws of England and Wales.

If you are a consumer resident outside England and Wales, you may also benefit from mandatory protections of the law of your country of residence, and nothing in this section prevents you from bringing proceedings in a court that is legally entitled to hear the claim under mandatory applicable law.

20. Changes to the Services or These Terms

We may update or change the Services, products, prices, policies or these Terms from time to time. If we make a material change to these Terms, we will update the "Last updated" date and, where required by law, provide additional notice. Changes will not apply retrospectively to orders already accepted unless required by law or where the change is clearly beneficial to you.

21. Severability

If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be treated as removed to the minimum extent necessary. The remaining provisions will continue in full force and effect.
